Please read these Terms and Conditions carefully before booking a class or purchasing any product or service from Sharon Burchall Cake Studio ('I', 'me', 'my').

By making a booking and/or payment, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

Sharon Burchall Cake Studio is operated as a sole trader business. These terms are governed by English law.

1.  Classes and Gift Certificates

1.1  Copyright and Intellectual Property

All designs, techniques, class notes, teaching methods, and recipes created and used by Sharon Burchall and Sharon Burchall Cake Studio are protected by copyright and remain the sole intellectual property of Sharon Burchall and Sharon Burchall Cake Studio at all times.

By attending a class, you are granted a personal, non-exclusive, non-transferable licence to use what you have learned for your own private cake making only. You are strictly prohibited from:

•       Teaching or demonstrating any techniques, designs, or recipes to any other person, whether in person, online, via social media, or by any other means;

•       Using designs or techniques learned at SBCS classes in any class, workshop, or demonstration you run or participate in as a teacher or demonstrator;

•       Sharing, copying, distributing, or reproducing class notes, recipes, or any other class materials in any format.

1.2  Right to Remove from Class

If I reasonably believe at any time that you intend to reteach or share any class content, that your behaviour is disruptive to others, or that you may delay the proceedings of the class to the detriment of other attendees, I reserve the right to ask you to leave immediately without further warning. No refund will be offered in these circumstances.

1.3  Changes to Class Content

I reserve the right to amend class content, structure, or materials at any time. Every effort will be made to inform attendees of significant changes in advance where possible.

1.4  Children in Classes

1.5  Classes may be suitable for children aged 13 and above. Any attendee under the age of 16 must be accompanied by a responsible adult who has also purchased a place on the class. Please contact me before booking to discuss suitability for younger participants. I am DBS-checked.

1.6   Cancellations, Refunds and Rescheduling

Due to the preparation required for each class, all payments are non-refundable.

•       Deposits are strictly non-refundable under all circumstances.

•       Once booked, classes cannot be cancelled.

•       Where possible, classes may be rescheduled or transferred to another date with sufficient notice, at my discretion.

1.6  Recording of Classes

Recording of classes by attendees is strictly prohibited by any means, including but not limited to video, audio, screen recording, or live streaming. Any breach of this clause may result in immediate removal from the class without refund.

You are welcome to photograph your own work. I may photograph work and attendees during or after the class for the purpose of advertising and social media (including Facebook, Instagram, LinkedIn, TikTok, and YouTube). If you do not wish your work or image to be photographed or used in this way, please inform me at the start of the class.

1.7 Illness and Hygiene

In accordance with Food Hygiene Standards and applicable law, if you have experienced sickness or diarrhoea within 48 hours prior to the class, you must not attend the premises. Please contact me as soon as possible if this applies to you. No refunds will be given in these circumstances, but I will use reasonable endeavours to assist you in finding a replacement attendee.

1.8 Allergies and Dietary Requirements

While I can accommodate certain dietary requirements where possible, I cannot guarantee an allergen-free environment.

All products are prepared in a kitchen where allergens such as (but not limited to) nuts, dairy, eggs, and gluten are used.

It is the responsibility of the attendee to inform me of any allergies or dietary requirements at the time of booking. I do not cater for severe or life-threatening allergies.

By proceeding with a booking, you confirm that all relevant allergy information has been disclosed.

1.9 No Guarantee of Results

Results may vary depending on individual skill, practice, and materials. While I provide guidance and instruction, I do not guarantee specific outcomes.

1.10 Class Amendments

In the unlikely event that I agree to any amendment to an existing booking at your request, an administration fee of a minimum of £10 per amendment will apply.

1.11 Replacement Class Notes

Replacement copies of class notes are available for a £10 administration fee. Notes may be collected in person or sent by post upon request. They will not be sent electronically.

2.  Gift Certificates

2.1  All Gift Certificates (‘Certificates’) issued by Sharon Burchall Cake Studio are subject to the following terms.

2.2  Validity

Certificates are valid for 12 months from the date of issue. No extensions will be granted under any circumstances. A class must be booked before the Certificate expiry date, even if the class itself is scheduled to take place after that date.

2.3  Redemption

Certificates may be redeemed against any scheduled class up to the printed value. A top-up payment may be made to attend a higher-value class or to exchange for a 1-2-1 class (subject to availability). Any unused balance may be carried forward and applied to a future class booking.

2.4  Transfer

Certificates are non-transferable without prior written confirmation by email from the named Certificate holder.

2.5  Non-Refundable

Once purchased, Certificates cannot be refunded or exchanged for cash.

3.  Online Classes

3.1  All content in online classes (including but not limited to classes delivered via Zoom, Facebook, or any other platform) is subject to the same terms as in-person classes, including those relating to copyright, recording, and conduct.

3.2  Technical Responsibility

It is your sole responsibility to download any required app, ensure your device is compatible, and understand how to access the class before it begins. I am unable to provide individual technical support.

3.3  Equipment and Materials

Please ensure you have all required tools, materials, and ingredients ready before the class begins. A list will be provided in advance.

3.4  Access and Login Details

Your login details, access codes, or meeting invitations are strictly personal and must not be shared with any other person under any circumstances. If sharing is identified, all parties involved will be removed from the platform, all access and subscriptions will be cancelled immediately, and no refund will be given.

3.5  Recording Prohibition

Recording and/or sharing of online classes by any means is strictly prohibited. Any breach may result in legal action being taken.

4.  Private Bookings

4.1  A non-refundable deposit is required to secure all private bookings. The deposit amount and due date will be confirmed on your invoice.

Your booking is not confirmed until the deposit has been received.

4.2  The remaining balance must be paid in full by the due date stated on your invoice (typically 14 days before the class date).

Failure to pay by this date will result in your booking being cancelled and your deposit forfeited.

4.3  No reminders for outstanding payments will be issued. It is your responsibility to ensure payment is made on time.

4.4  All other Terms and Conditions applicable to in-person or online classes apply equally to private bookings.

5.  Payments — Group Classes

5.1  Full payment for group classes is due immediately at the time of booking. Your place will not be confirmed until full payment has been received.

5.2  Booking confirmation will be sent by email (or other agreed format) once payment has been received.

5.3  If another booking is received before your payment is made, you may lose your place. No place will be held without payment.

5.4  Non-Refundable Payments

All payments for group classes are non-refundable, subject to your statutory rights under UK consumer law.

5.5  14-Day Cooling-Off Period — Online Purchases

For bookings made online, you have the right to cancel and receive a full refund within 14 days of the date of booking, provided the class has not yet taken place. After this period, no refund will be issued.

If you book a class that takes place within 14 days of booking and the class is delivered in full, or you fail to attend, you waive your right to cancel or receive a refund.

5.6  Digital Downloads and Immediately Available Content

For digital downloads or classes available immediately upon purchase, by completing your purchase you acknowledge and agree that you waive your statutory right to cancel or receive a refund.

5.7  No Payment Reminders

Sharon Burchall Cake Studio will not issue reminders for outstanding payments. It is your responsibility to ensure payment is made promptly to secure your booking.

6.  Digital Products

6.1  All digital products, including downloadable guides, templates, recipes, and class recordings (where applicable), are the intellectual property of Sharon Burchall Cake Studio and are licensed for your personal use only.

6.2  You may not copy, reproduce, distribute, sell, or share any digital product in any format, in whole or in part, without prior express written permission from Sharon Burchall Cake Studio.

6.3  As digital products are delivered immediately upon purchase, all sales are final. No refunds will be given once the product has been downloaded or accessed.

7.  General

7.1  Website Content

All content on the Sharon Burchall Cake Studio website, including but not limited to designs, layouts, text, images, and photographs, is the property of Sharon Burchall Cake Studio. It may not be copied, reproduced, or used in any format or for any purpose without prior express written permission. This clause relates to website content only; a separate Website Terms of Use document also applies.

7.2  Force Majeure

Sharon Burchall Cake Studio will not be liable for any failure to perform or delay in performing its obligations arising from circumstances beyond its reasonable control, including but not limited to:

•       Failure to receive materials from third-party suppliers;

•       Extreme weather conditions;

•       Impossibility of use of any relevant means of transport;

•       Acts or attempted acts of terrorism;

•       Any epidemic, pandemic, or other widespread or localised disease outbreak.

In such circumstances, every effort will be made to minimise disruption. Where a class cannot go ahead, an alternative date will be offered. No refunds will be given in these circumstances.

7.3  Limitation of Liability

The maximum liability of Sharon Burchall Cake Studio to you in connection with any booking, product, or service will not exceed the amount you paid for that booking, product, or service. Nothing in these Terms and Conditions limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

7.4  Data Protection and Privacy

Any personal information you provide will be held securely and used only for the purposes of managing your booking and communicating with you about your class or purchase. Your data will not be shared with third parties and will be retained only for as long as is necessary for record-keeping purposes. Please refer to my separate Privacy Policy for full details.

7.5  Insurance and Compliance

Sharon Burchall Cake Studio holds relevant Public Liability Insurance and operates under HACCP guidelines for all food production, handling, storage, and distribution. The studio is registered with the local authority and undergoes regular inspections in accordance with the law.

7.6  Governing Law

These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with English law. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

7.7  Amendments to These Terms

These Terms and Conditions may be updated at any time without prior notice. The version in force at the time of your booking will apply to that booking. The current version will always be available on request.
